GENERAL REGULATION OF THE PARK

REGULATION

1) FULL PARK RULES

Acquatica Park General Terms and Conditions

The purchase of a ticket, season ticket and/or entry to the Park implies full acceptance of these regulations. All visitors are required to read and comply with them. Park staff are authorised to enforce these regulations and to take the necessary measures to ensure safety, order, hygiene and the proper use of the facilities.

Art. 1 – Access to the Park

Access to the Park is permitted only to holders of a valid admission ticket. Tickets or season tickets must be retained for the duration of the visit and shown to staff on request. The Park reserves the right to refuse entry or order the removal of anyone whose behaviour contravenes these regulations, safety, hygiene, public decency or instructions given by staff.

Art. 2 – Opening hours and availability of services

The opening days and times of the Park, swimming pools, slides, attractions, food and drink outlets and facilities are subject to change for technical, organisational, safety, maintenance, visitor numbers, weather conditions or force majeure reasons. The Park reserves the right to suspend, restrict or temporarily close individual attractions, pools, areas or services without this giving rise to any entitlement to a refund, except as provided for in Article 13 in the event of the total closure of the Park by decision of the Management.

Art. 3 – Minors

Children must be supervised at all times by the accompanying adults. Acquatica Park accepts no responsibility for unaccompanied children in the park. The accompanying adult is responsible for the child’s behaviour and for ensuring compliance with these regulations..

Art. 4 – General rules of conduct

Visitors must behave in a proper, respectful and considerate manner whilst in the park. The following are prohibited:
a) running in wet areas or near the pools;
b) pushing, diving where not permitted, obstructing the normal use of the attractions or creating dangerous situations;
c) behaving in a manner that is disruptive, offensive, aggressive or contrary to public decency;
d) damaging structures, equipment, furnishings, signage or green areas;
e) behaving in a manner contrary to hygiene, safety or decorum.

Staff may order the immediate removal of guests who breach the regulations, without entitlement to a refund.

Art. 5 – Use of swimming pools, slides and attractions

Each attraction is subject to specific conditions of use indicated by signage, pictograms, operating instructions and staff instructions. Guests are required to comply fully with these instructions. Access to attractions may be prohibited or restricted on the basis of age, height, physical condition, state of health, clothing, overcrowding or safety requirements.

Art. 6 – Physical conditions and restrictions

The use of slides, pools and attractions may be discouraged or prohibited for pregnant women, or those with heart conditions, spinal problems, recent injuries, plaster casts, braces, reduced mobility or health conditions incompatible with immersion, speed, impact, sliding or sudden movements. All guests are required to assess their own physical fitness for use of the facilities in advance.

Art. 7 – Hygiene, clothing and access to pools and attractions

Visitors with long hair must tie their hair back before entering the pools.

To access the swimming pools, slides and water attractions, it is compulsory to wear suitable swimwear, made from materials and in styles appropriate for swimming in a public place, in accordance with hygiene and safety requirements and the correct use of the facilities and attractions.

It is strictly forbidden to enter the pools, water slides and water attractions without wearing swimwear, even in the case of babies and young children.

Children who normally wear nappies must wear special swim nappies, commonly known as ‘swimmers’, or other equivalent devices specifically designed for swimming. Standard nappies are not considered suitable for use in the water. In the absence of such devices, access to the pools and water attractions will not be permitted.

It is not permitted to enter the water, pools, slides or attractions whilst wearing clothing not intended for swimming, such as, for example: jeans, trousers, skirts, jumpers, sweatshirts, dresses or other unsuitable garments.

The use of more modest swimwear is permitted only if it is specifically designed for water activities and complies with these regulations and the rules of the individual attractions.

Should a guest not be wearing suitable swimwear or, in the case of young children, a suitable swim nappy, and be unable to obtain such items, they will be denied access to the pools, slides and water attractions, with no entitlement to a refund of the ticket price on these grounds.

The decision as to whether clothing and swim nappies are suitable for access to the pools and attractions rests with the designated staff and the Park Management; their judgement shall be deemed binding for the purposes of safety, hygiene and the proper functioning of the facilities.

The use of balls, frisbees, small balls, boomerangs and similar items is not permitted in the swimming pools or on the attractions. Their use may be permitted in the designated play areas.

Art. 8 – Personal belongings and prohibited items

It is forbidden to bring into or use dangerous or potentially harmful objects in the Park, including glass, knives, blunt objects and the like. The Park accepts no liability for theft, loss or damage to personal belongings left unattended. The use of lockers or storage facilities is governed by the relevant terms and conditions. Scooters, bicycles, skateboards and similar items are not permitted in the Park.

Art. 9 – Food, drink, smoking and pets

Unless otherwise specified by the Management, it is forbidden to bring in glass bottles or containers and other objects that may pose a danger. For reasons of service organisation, decorum, hygiene and safety, it is not permitted to bring food or meals from outside into the Park. Only small snacks or sandwiches for personal consumption are permitted. Furthermore, the delivery into the Park of food or meals ordered from external establishments, including delivery services, is not permitted. Smoking is prohibited in areas where it is prohibited by law or by Park signage. Animals are not permitted under any circumstances.

Art. 10 – Staff requirements and safety

Visitors are required to follow all instructions given by park staff, lifeguards and security personnel. Failure to comply with these instructions may result in being barred from using the attractions, being asked to leave the park, and any further measures deemed necessary.

Art. 11 – Partial closures and suspension of services

The temporary suspension of one or more services, attractions, pools or areas, due to maintenance, breakdowns, safety reasons, weather conditions, operational requirements or other causes, does not entitle the holder to a full or partial refund of the ticket price, except in the event of the Park’s complete closure by decision of the Management in accordance with Article 13.

Art. 12 – Photography and video recording

During the Park’s opening hours, general photographs and/or videos may be taken of the common areas, attractions and the Park’s surroundings for the purposes of institutional communication, promotion and the showcasing of the Park’s activities on official channels, including the website, social media and information materials.

Such filming will be carried out in accordance with the principles of lawfulness, fairness, transparency, data minimisation and respect for human dignity.

There may also be a photographer on site who takes photographs of guests solely for the purpose of allowing them to view the images and, if interested, purchase them. Photographs that are not purchased will normally be deleted by the end of the day.

These images will not be used for promotional or dissemination purposes, unless there is a valid legal basis for doing so and, where necessary, subject to the specific consent of the data subject or the person exercising parental responsibility in the case of minors.

Guests who do not wish to appear in general footage or take part in the photo shoot may inform the staff, the information desk or the photographer directly. The full privacy policy is available on the Park’s website and at the information points (Privacy Policy)

Art. 13 – Tickets, bad weather, re-use and refunds

Tickets purchased are non-refundable, non-changeable and cannot be exchanged for cash, except in the cases expressly provided for in these regulations, the terms and conditions of purchase or applicable law. In the event of rain or bad weather, no refund is automatically due.

Should the Management decide to close the Park entirely due to rain or bad weather, the customer shall be entitled to use the purchased ticket on any other day the Park is open before the end of the season, in accordance with the procedures communicated by the Management.

Only if the customer can demonstrate, with appropriate documentation, that it is objectively impossible to use the ticket at a later date for health reasons or for documented logistical reasons, may they submit a refund request by sending a formal email to info@acquaticapark.it. The request will be assessed by the Park on a case-by-case basis.

Refund requests must be submitted promptly and, in any event, within 3 days of the Park’s last official opening day of the season.

The ticketing system used by the Park allows for the cancellation and refund of tickets issued exclusively within this timeframe. Once the 3-day period following the last day of the season has elapsed, tickets are incorporated into the administrative, tax and accounting procedures for the season and can no longer be cancelled or refunded via the ticketing system.

Consequently, after this deadline, requests for a refund will not be accepted, even if accompanied by supporting documentation or based on health, logistical, personal or unforeseen reasons.

Acquatica Park may, however, at its sole discretion and without this constituting an acknowledgement of any obligation, right to a refund or precedent, offer alternative commercial solutions, such as complimentary admission, vouchers, replacement tickets or other concessions.

The partial closure of attractions, pools, areas or services, even if due to bad weather, does not constitute a total closure of the Park and does not entitle the holder to a refund or a replacement ticket.

In any event, the mandatory rights granted to the consumer under current legislation remain unaffected.

Art. 14 – Season tickets

Season tickets are valid only on the days and during the opening hours of the Park and, if issued in a specific name, are strictly personal and non-transferable.

Failure to use the season ticket, as well as theft, loss, damage or other circumstances not attributable to the Park, do not entitle the holder to a refund or, unless otherwise decided by the Management, to the issue of a replacement ticket.

The Management reserves the right to suspend or cancel the season ticket, without entitlement to a refund, in the event of misuse, unauthorised transfer or conduct contrary to the Park’s regulations.

Any services included in the subscription, such as sun loungers, are subject to availability and are provided on a first-come, first-served basis.

Art. 15 – Removal

Any breach of these regulations may result in being denied access to the attractions, immediate removal from the Park and, in the most serious cases, referral to the relevant authorities. In such cases, no refund will be given.

Art. 16 – Deferral

Insofar as not expressly provided for in these regulations, the provisions of current legislation and the terms and conditions of purchase published on the Park’s website shall apply
